It's About The Restitution


We must remind the Jewish Claims Conference about their fundamental obligation; that it is abut restitution. That as long as living heirs remain claim, a
ny restitution received by the German or any other Government, does not belong to the Claims Conference. 

Facts

  The JCC is an intermediary organization created to handle restitution cases. 

The JCC is legally and morally responsible to complete the restitution process. 

The JCC is NOT a Victim of Nazi Persecution

The JCC is NOT a Victim or a Holocaust Survivor

The JCC is NOT a victim, legal descendant or heir to any claim unless it is heirless..

The JCC is NOT legally or morally entitled to keep the restitution they receive unless it is heirless.

Unclaimed does not mean heirless.

    The JCC's primary obligation and responsibility is restitution,
not their peculiar brand of unsupervised selective philanthropy.
  


    The Jewish Claims Conference cannot simply place a deadline on restitution claims and has a legal and moral obligation to complete the restitution process.  Any organization that impedes the restitution process is behaving negligently. It's not their money. It never was and never will be. They're hoping the legal heirs will die off before they're forced to pay.


We're not alone

Eli Zborowski, 77, of New York, a Claims Conference board member, says the argument over the 80-20 split between survivor needs and education misses the point. Proceeds from the East German property sales belong solely to the heirs of German Jews, not all survivors, he said. "There is no such thing as survivors money"**

"By dedicating some money to Holocaust education rather than the survivors themselves, the Claims Conference is "acting like a general philanthropic organization," Leo Rechter said. "But we think it's not their money to dispose of." " **


Be Afraid, Be Very Afraid..

Julius Berman, chairman of the Claims Conference, says the mandate of the East German property settlement includes the mission to "memorialize the people and the way they lived." ** 

"Holocaust survivors are not the only persons charged with making decisions for the Jewish people about how to use monies that will not be needed after they die," -- Israel Singer, President of the Claims Conference, and instrumental in negotiating restitution agreements around the world. **

In his July 15th, 2009 letter, Juergen Roth, Deputy Director of the Claims Conference Nachfolgeorganisation (Frankfurt), formally refused to provide us with a requested document.  It was a copy of the proof of payment received by the JCC from the German Government.  The German Government acknowledged the payment, directed us to request it from the Claims Conference, yet Mr. Roth refuses to provide a copy of the document.

He wrote; “Since the Claims Conference needs legal certainty and the Goodwill Fund is only a voluntary institution by the Claims Conference. It is our (the Claims Conference’s) main duty to allocate funds for social care programs for the benefit of needy holocaust survivors."  He then went on to write: 
"As your concern cannot be considered, it makes no sense to continue the discussion about the details of the case.

It appears that Mr. Roth has become confused as to his organization's obligations.  He has come to believe that the Claims Conference is entitled to keep the proceeds it collects.  The original mandate of restitution has been forgotten.

For us this will be a process of obtaining justice through reparation, as well as remembrance and education. While reacquainting ourselves with Third Reich injustices towards our families, we can also help remind the Jewish Claims Conference about their fundamental obligations. As long as living heirs remain alive to file a claim, a
ny restitution received by the German or any other Government, does not belong to the Claims Conference.
